Modification and Enforcement

Protecting Your Rights After the Divorce is Final

At Scaringi & Scaringi, P.C., much of our family law work takes place when a client seeks enforcement of an important right in the divorce decree, or needs advice about modifying established obligations to better fit changed circumstances. If you need advice about your legal options in the enforcement or modification of a divorce decree or family court order, contact us in Harrisburg or Newport for a free consultation.

Call 717-567-0380 or 717-798-3601 for Advice About Modification

On modification matters, our attorneys can give you a good idea whether the change in your situation is substantial enough to justify seeking an order from the court or negotiation of an amended child support obligation or visitation schedule with your former spouse. Minor changes in circumstances won't generally support a motion for modification, but such major events as the loss of a job, a continuing health crisis or the cohabitation of your former spouse probably will.

Many of our clients need legal advice about parental relocation proposals. When the parent with primary physical custody of the children wants to move out of state or to another part of Pennsylvania, the other parent's legal custody and visitation rights come under threat. Even when the reasons supporting the move are strong, the parent left behind has a lot to say about the resulting physical custody arrangements, and a court won't likely approve the move over objections. Our attorneys can advise you about your options on either side of a relocation proposal.

We Advise Clients on Either Side of a Family Court Enforcement Issue

We also handle a wide range of family court enforcement matters. Unpaid child support, interference with visitation, and unsatisfied alimony commitments can all support an action for enforcement, which can be backed up by the court's contempt power. Jail is a realistic possibility for the party in default. We can handle either side of enforcement cases.

An increasingly important aspect of our practice involves the enforcement of family court orders from other states. If the other parent of your child moved the family to Pennsylvania without the proper court authorization in your home state, we can use the Uniform Child Custody Jurisdiction Enforcement Act to protect and enforce your interests here. We also enforce the rights of Pennsylvania parents against those who moved their children to different states or foreign countries.
